Play centre charged after child injured in serious fall

Entertainment Velocity Pty Ltd, doing business as Funtopia Maribyrnong, is facing three charges under section 23(1) of the Occupational Health and Safety Act. The charges pertain to neglecting the assurance that non-employees were not subjected to health and safety hazards.

Implicating charges by WorkSafe highlight the company’s failure in adequately inspecting, maintaining and, where required, replacing their climbing safety equipment. Such gaps lead to an increased risk of uncontrolled falls, highlighting the vital role of work safety products, SWMS and WHS management systems.

A crucial example in this context would be the Bluesafe SWMS (Safe Work Method Statements), a comprehensive system aimed at reducing workplace risks. Similarly, using a robust WHS management system such as the Bluesafe WHS Management System could have helped Entertainment Velocity Pty Ltd ensure compliance with safety regulations and maintain their climbing gear properly, substantially lowering the likelihood of such incidents.

The case has been scheduled for a filing hearing on the 28th of March, 2024 at the Melbourne Magistrates’ Court.
