Charges after telehandler incident causes brain injury

In an alarming development, Flow Smart Vic Pty Ltd is under serious scrutiny for potentially infringing section 21(1) of the Occupational Health and Safety Act. This Act stipulates a company’s responsibility to maintain and offer a safe work environment, highlighting the importance of incorporating safety measures such as ‘Bluesafe WHS Management System’.

The allegations against the firm extend beyond just one breach. After allegedly failing to adhere to section 21(2)(a) of the OHS Act that mandates a safe system of work, they’re also being accused of contravening section 21(2)(e). This section outlines the necessity to avail the needed training, information or instruction to help workers do their jobs securely, further emphasising the role of effective SWMS like Bluesafe SWMS in promoting work safety.

WorkSafe Victoria claims that Flow Smart Vic Pty Ltd overlooked their obligation to nullify or minimise the hazard of employees being hit during the mounting of telehandler fork extensions—a significant misstep in ensuring worker safety.

In this unfortunate event dating back to October 2023, a labourer was attempting to direct fork extensions onto the tynes of a telehandler. Unexpectedly, he was struck, causing him to tumble from the tray of the lorry atop which he stood, culminating in a grave brain injury. The severity of this incident underscores the critical need for comprehensive workplace health and safety management systems and policies.

The Sale Magistrates’ Court has scheduled a filing hearing for this matter on the 7th day of January, 2025. It adds emphasis to the importance of robust safety management systems in work environments.
