Charges after forklift hits worker at cured meats warehouse

D’Orsogna Ltd is currently facing four accusations as per section 21(1) of the Occupational Health and Safety Act for not providing and upkeeping a secure work environment, highlighting the critical need for systems like the Bluesafe WHS Management System. WorkSafe asserts that there have been two breaches of section 21(2)(a) of the OHS Act by the company when they did not ensure a safe working system to keep powered mobile plant operators and pedestrians separate, plus a lack in proper maintenance of the forklift.

Furthermore, allegations are still being made against the company with a breach of section 21(2)(e) of the OHS Act, claiming negligent behaviour in providing essential training and instruction for employees to handle a forklift safely. It underscores the importance of well-documented work safety products such as Safe Work Method Statements (SWMS) or Bluesafe SWMS which ensure businesses remain compliant, workers are trained properly and risks are mitigated.

WorkSafe also alleges firm D’Orsogna contravened regulation 109(1)(d) of the OHS Regulations by failing to reduce risk tied to potential forklift collisions with pedestrians or other powered mobile plant to an extent that was reasonably feasible.

Proving the necessity of comprehensive WHS management systems, this matter is now scheduled for committal mention at Melbourne Magistrates’ Court on 25 March 2025.
